Terms and Conditions
Great Clips, Inc. (“Sponsor”) is sponsoring The Great Tools Giveaway for Cosmetology and Barbering students.
Eligibility: The Great Tools Giveaway (“Giveaway”) is offered exclusively to legal residents of the United States who are at least 16 years of age and students enrolled in a high school cosmetology or barbering program at the time of submission. Employees, officers, directors, and agents of Sponsor, its franchisees, its affiliated companies or agents, their respective advertising or promotional agencies, its media sponsors, or the third parties engaged by Sponsor to assist it in administering the Giveaway or a member of any such employee’s immediate family (regardless of where they live) or persons with whom they are domiciled (whether related to the employee or not) are not eligible to participate in the Give- away. Federal, state, provincial and local laws and regulations apply. By applying, participating in, or accepting a prize, you agree to these Terms and Conditions. Sponsor may change, suspend, or terminate the Giveaway or Terms and Conditions at any time. Persons who are under the age of majority in their jurisdiction of residence at the date of entry are eligible to enter the Giveaway and win a prize provided that the parent or legal guardian of such entrant provides all consents, waivers, declarations, etc. requested by the Sponsor on behalf of such entrant. Void were prohibited by law.
Giveaway Submission Process: The Prizing Period is set forth below.
Prizing Period is from May 1, 2023 – April 30, 2024
To enter, entrants will follow the QR code on the program flyer (provided to them by the Great Clips representative visiting their school or event). Students will follow the QR code to a landing page where they will, provide all information requested, and agree to opt-in to be contacted by a Great Clips representative if they are chosen to receive the prize award.
The submission must be received by Sponsor by 11:59 p.m. Eastern Time on the last date of the Prizing Period. The Sponsor’s computer is the official timekeeper. All submissions not selected during the Prizing Period will be deemed void and the submission will not be eligible.
By completing an application, you represent that the information you are providing to Sponsor is truthful and accurate. Incomplete applications will be null, and void and Sponsor retains the right to reject applications for failure to comply with these Terms and Conditions or otherwise meet eligibility requirements.
Giveaway Selections Process: a total of ten (10) winners will be selected at random during the Prizing Period. Each winner will receive a hairstylist tool kit valued at $250.00, salon value, comprised of items chosen in Sponsor’s discretion based on value and availability which may include such products as an electric clipper, trimmer, shears, razors, flat iron, cape, combs, brushes, sprayer, grip clips, dryer, hair care product, and related items. The odds of winning a prize depend on the total number of eligible entries received. Total ARV: US$250 per winner; US$2,500 for all winners. All prizes are nontransferable, non-assignable, non-negotiable, and not redeemable for cash or credit. Prizes must be accepted as awarded. Certain conditions and restrictions may apply. Prizes are awarded “AS IS” with no warranty, representation, or guarantee, express or implied, in fact or in law, made by Sponsor or for which Sponsor shall be liable, including, without limitation, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. Sponsor reserves the right to substitute a prize of the same approximate retail value. All costs and expenses not specified herein, related to any prize or incurred by accepting the prize, are the sole responsibility of the winner, including any taxes associated with the prize. Any elements of the prize or awarding of the prize that are not specifically outlined herein will be determined by Sponsor in its sole discretion. Once awarded to the winner, the Sponsor shall have no liability whatsoever for the prizes or the use or misuse of the prizes by the winners. Upon receipt of any prize, the winner is required to comply with all applicable federal, state, territorial, and local laws, rules, and regulations.
Award Notification: A representative from Sponsor will announce the prize winners no later than October 31, 2023. Winners will be notified in person at the cosmetology school or barbering school provided, or via email or phone communication as determined solely by Sponsor. In the event the potential recipient does not respond to notification within 5 days, the Sponsor may grant the prize to another applicant.
Before being awarded a Prize, each potential winner (or, if under the age of majority, his or her parent or legal guardian) will be required to sign and return within the time stipulated by the Sponsor, a publicity release, declaration and liability release form stating that he/she (i) has read and understood the Terms & Conditions, (ii) grants all consents required, (iii) authorizes the Sponsor to broadcast, publish and disseminate his/her name, city of residence, photograph, likeness, sobriquet, voice, video and vlog in connection with any promotion or publicity, and/or for general news, entertainment and information purposes at no additional compensation to the potential winner beyond the awarding of the prize, (iv) accepts the prize as offered (where applicable), and (v) releases the Sponsor (and its affiliated and related companies, advertising and promotional agencies, the parties engaged by Sponsor to assist it in administering the Giveaway and their respective shareholders, directors, officers, employees, agents, representatives, successors and assigns) (“Sponsor Parties”) from any liability in connection with the prize or this Giveaway.
Limitation of Liability: By submitting an application (whether or not an award is issued or received), all applicants hereby waive and release, and agree to hold harmless the Sponsor Parties from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death, and/or property, arising in whole or in part, directly or indirectly, from their participation in the Scholarship or receipt of an award. Sponsor Parties are not responsible for lost, late, damaged, delayed, incomplete or misdirected applications, or for any technical failure of any site or any technology related to the application or Giveaway.
If for any reason the Giveaway is not capable of running as planned, including without limitation disruptions caused by any device, computer, virus, bugs, tampering, unauthorized intervention, fraud, technical failures, acts of God, factors beyond Sponsor’s reasonable control, Sponsor reserves the right, but shall have no obligation, to cancel, terminate, modify or suspend the Giveaway, and may substitute an appropriate alternate method of prize award selection, including to award the prizes from among all valid and eligible entries received up to the time the Giveaway was interrupted.
By entering, you agree to accept and abide by these Terms & Conditions of this Giveaway and agree that any dispute with regard to the conduct of this Giveaway, rule interpretation or award of a prize, shall be resolved by Sponsor, whose decisions shall be binding and final. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications failure, theft, destruction or unauthorized access to, or alteration of, entries, including any erroneous appearance of qualification for a prize. Sponsor is not responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, servers or provider, computer equipment, software, failure of any e-mail or entry to be received by Sponsor due to technical problem or traffic, congestion on the internet or at any web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Giveaway. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Disputes: Each prize recipient and agrees that any disputes or claims related to the prize Giveaway shall be resolved individually, without resort to a class action and all proceedings shall take place in federal or state court in the state of Minnesota, applying Minnesota law (without regard to conflict of law provisions). All judgments or awards shall be limited to actual incurred out-of-pocket expenses (excluding attorneys' fees) associated with participation in this Giveaway and shall not include any indirect, punitive, incidental and/or consequential damages.
Privacy/Publicity Release: By participating in the Giveaway, entrant: (i) grants to the Sponsor the right to use his/her name, likeness, any comments, biographical information, mailing address, telephone number, and e-mail address (“Personal Information”) for the purpose of promoting the Sponsor and/or administering the Giveaway, including but not limited to contacting and announcing the winners; (ii) grants to the Sponsor the right to collect, use and disclose his/her Personal Information for publicity and promotional purposes relating to promoting the Sponsor and/or administering the Giveaway, in any and all media now known or hereafter devised, without further compensation unless prohibited by law; and (iii) acknowledges the Sponsor will otherwise use the Personal Information in a manner that is consistent with the Great Clips Privacy Policy at: http://www.greatclips.com/privacy- notice. Sponsor Parties shall not incur any liability whatsoever to the extent Sponsor Parties choose to partake or refrain from any exploitation of its rights hereunder.
Winners List: For the name of the Giveaway winners, send your request in a self-addressed, stamped envelope to: “The Great Tools Giveaway” c/o Great Clips, Inc., 4400 West 78th Street, Suite 700, Minneapolis, MN 55435. Request must be received by November 30, 2023.
